1. Eligibility By using the YouJustGetMe.com website, you agree to be bound by these terms of use ("Terms of Use" or "Agreement"). By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the Terms and Conditions of this Agreement. Use of and Membership in the Service void where prohibited. For the purposes of this Agreement, those who use YouJustGetMe.com are "Users." This group includes anyone who registers for YouJustGetMe.com, who are "Members." Your use of the Site is subject to the Terms of Use whether or not you registered to become a Member. Please read these Terms of Use carefully and save it. If you do not agree with it, you should leave the YouJustGetMe Website and discontinue use of the YouJustGetMe services immediately. Use of YouJustGetMe's is also governed by YouJustGetMe's Privacy Policy , which is incorporated into this Agreement by reference.
   
   YouJustGetMe.com may modify the Terms of Use from time to time and such modification shall be effective upon posting by YouJustGetMe on the YouJustGetMe.com Website. You agree to be bound to any changes to this Agreement when you use the YouJustGetMe services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes. If there are significant changes to the Terms of Use or the Privacy Policy YouJustGetMe will notify you at the email address you provided upon registering and/or by posting a notice on YouJustGetMe.com for a period of thirty (30) days.
   
   You must be at least Fourteen years or older to use YouJustGetMe and if you are between the ages of fourteen and seventeen years old you must first obtain your parents permission before using YouJustGetMe.com. By using YouJustGetMe you represent and warrant that you are either eighteen years or older or that you are between the ages of fourteen and seventeen and have obtained your parents permission. YouJustGetMe.com allows child-to-child contact and adult-to-adult contact via the Site, but strictly prohibits adult-to-child contact. Refer to the Privacy Policyfor additional details.


2. Term and Termination. This Agreement shall remain in full force and effect for as long as you use the Site and/or remain a member of YouJustGetMe.com. You may terminate your Membership at any time, for any reason, by sending an email from the address you registered with to memberships@youjustgetme.com with the word "terminate" entered in the subject line. Allow five (5) business days for removal of your information from the Site.
   
   YouJustGetMe.com may terminate your Membership at any time, for any reason, without warning. YouJustGetMe.com is not required, and may be prohibited, from disclosing a reason for the termination of your account. Even after your Membership is terminated, this Agreement will remain in effect. All terms that by their nature survive termination of this Agreement shall be deemed to survive such termination.


3. Intellectual and Property Rights. The content included on this Site, including, but not limited to tests, reports, text, graphics, logos, icons, and images is the exclusive property of YouJustGetMe.com and other respective owners that have granted YouJustGetMe.com the right and license to use such property and is protected by United States and international copyright laws. All trademarks, service marks, and trade names are proprietary to YouJustGetMe.com or other respective owners that have granted YouJustGetMe.com the right and license to use such marks. The YouJustGetMe.com site contains copyrighted material, including, but not limited to: trademarks and other proprietary information, content, text, and graphics. Except as otherwise expressly permitted under copyright law, Users may not copy, publish, redistributed, modify, transmit, display, sell, create derivative works, or in any way exploit the content or any portion of the YouJustGetMe.com site without the express permission of the organization.


4. User Posted Content. By posting content on YouJustGetMe.com, you automatically grant, and you represent and warrant that you have the right to grant, to YouJustGetMe.com an irrevocable, perpetual, non-exclusive, fully paid and royalty-free, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing. The posting of a third party's copyrighted material on YouJustGetMe.com by a User is strictly prohibited. YouJustGetMe.com, at its sole discretion may delete any content that violates these terms of use or is in any other way offensive, illegal, or that might violate the rights, harm or threaten the safety of other YouJustGetMe.com Users.
   
   You are solely responsible for the Content that you publish or display or link to on YouJustGetMe.com, or transmit to other Users. Your use of the Service, including but not limited to the Content you post on the Service, must be in accordance with any and all applicable laws and regulations. You will not post on the Site, or post links to, or transmit to other Users any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). Users are prohibited from listing their personal contact information such as street address, phone number, email address or instant messaging handles, except as provided for in Member registration where required.


5. Content/Activity Prohibited. YouJustGetMe.com may delete any content that in the sole judgment of YouJustGetMe.com violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. YouJustGetMe.com assumes no responsibility for monitoring the YouJustGetMe site for inappropriate content or conduct. YouJustGetMe.com assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the User submitting any such content, but may remove such content at any time for any reason.
   
   You are solely responsible for the content that you post on YouJustGetMe, and any material or information that you post links to or transmit to other Users and for your interactions with other Users. YouJustGetMe.com does not endorse and has no control over the content. Content is not necessarily reviewed by YouJustGetMe.com prior to posting and does not necessarily reflect the opinions or policies of YouJustGetMe.com. YouJustGetMe.com makes no warranties, express or implied, as to the Content or to the accuracy and reliability of the content or any material or information that you transmit or cause to be transmitted to other Users.
   
   The following is a partial list of the kind of content that is illegal or prohibited to post on YouJustGetMe.com. YouJustGetMe.com reserves the right to investigate and take appropriate legal action against anyone who, in YouJustGetMe.com's sole discretion, violates this provision, including without limitation, removing the offending communication from the YouJustGetMe Services and terminating the Membership of such violators. Prohibited content includes, but is not limited to content that, in the sole discretion of YouJustGetMe.com:
   • is patently offensive and promotes racism, hatred or physical harm of any kind against any group or individual;
   • harasses or advocates harassment of another person;
   • exploits people in a sexual or violent manner;
   • contains nudity, violence, or offensive subject matter or contains a link to an adult website;
   • solicits personal information from anyone under 18;
   • provides any telephone numbers, street addresses, last names, URLs or email addresses;
   • promotes information that you know is false or misleading or promotes illegal activities or
   • conduct that is abusive, threatening, obscene, defamatory or libelous;
   • promotes an illegal or unauthorized copy of another person's copyrighted work, such as
   • providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
   • involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spam" or "spamming";
   • contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
   • furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
   • involves commercial activities and/or sales without our prior written consent;
   • includes a photograph of another person that you have posted without that person's consent


6. Non Commercial Use by Members. The Site is for the personal use of individual Members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and should not use the Service or Site for any purpose. Illegal and/or unauthorized uses of the Site, including collecting display names and/or email addresses of Users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.


7. User Disputes. You are solely responsible for all interaction between yourself and other Users. YouJustGetMe.com reserves the right to intervene at its own discretion. Do not use this site to threaten the safety of others. All such incidents will be reported to the appropriate law enforcement channels. In no event shall YouJustGetMe.com be liable for any damage whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Service, including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meeting with other Users of this Service or persons you meet through this Service. You agree to take reasonable precautions in all interactions with other Users of the Service, particularly if you decide to meet offline or in person.


8. Privacy Policy. Use of the Site and service is also governed by our Privacy Policy.


9. Communication. As a part of the service YouJustGetMe.com provides to our registered Members, we communicate via email and other means to inform you of enhancements or changes in offerings, services, or other relevant information targeted to your interests. Details of these communication efforts are noted within the Privacy Policy. Members have the option to remove themselves from various email communications by following the conditions listed within the message or by following the procedures on the My Account page. However, even though Members may request removal from the distribution of specific emails, YouJustGetMe.com has the right to send other messages from time to time that we believe would interest them. YouJustGetMe.com reserves the right at any time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice.


10. Advertiser Links. This website contains links to Internet websites maintained by third parties. YouJustGetMe.com does not operate or control in any respect any information, products, or services on such third-party sites. Third-party links do not constitute any endorsement by YouJustGetMe.com and/or its affiliates. Users assume sole responsibility for use of these third-party links. The disclaimers set forth herein are equally applicable to such third-party sites.


11. Limitation of Liability. Except in jurisdictions where such provisions are restricted, in no event will YouJustGetMe.com be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit arising from your use of the Site or service.


12. Disclaimers. YouJustGetMe.com is not responsible for any incorrect or inaccurate content posted on the YouJustGetMe Website, whether caused by Users or Members of YouJustGetMe or by any of the equipment or programming associated with or utilized in the YouJustGetMe website. The Web site and service are provided on an "As-Is" basis. YouJustGetMe.com disclaims any warranty of fitness and any warranty for a particular purpose or non-infringement. YouJustGetMe.com makes no guarantee whatsoever about any specific results from the use the Site or Service. YouJustGetMe.com is not responsible for incorrect or inaccurate content posted on the Site. YouJustGetMe.com assumes no responsibility for technical difficulties, including computer malfunctions, disconnects, and server failure, or failure to receive notices via email. Under no circumstances will YouJustGetMe.com be responsible for any loss or damage resulting from anyone's use of the site or the service and/or any content posted on the YouJustGetMe.com site or transmitted to YouJustGetMe.com Users. YouJustGetMe.com does not assume any responsibility or liability for any third party advertisers or any other third party offer. User agrees to indemnify and hold YouJustGetMe.com, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, for any dispute due to or arising out of your use of a third party offer or advertisement or promotion.


13. Indemnity. You agree to indemnify and hold YouJustGetMe.com, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.


14. Choice of Law and Venue. The Terms of Use, your access and use of the Website and Services and the relationship between you and YouJustGetMe.com is governed by the laws of the State of Washington, without giving effect to its conflict of law provisions. YouJustGetMe.com and you both agree to submit to the personal and exclusive jurisdiction of the courts of the State of Washington. You are responsible for complying with local laws, if and to the extent local laws are applicable. Notwithstanding the foregoing, YouJustGetMe.com shall have the right to commence and prosecute any legal or equitable action or proceeding before any United States or non-United States court of competent jurisdiction to obtain injunctive or other relief in YouJustGetMe.com's sole discretion. Regardless of any statute or law to the contrary, any claim or cause of action by you arising out of or related to use of the Website or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.


15. Entire Agreement. These Terms & Conditions represent the complete and entire agreement between YouJustGetMe.com and you and supersede all prior and contemporaneous agreements of the parties relating to the subject mater hereof. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. You acknowledge that you have read these Terms & Conditions and understand and agree to all of them in their entirety. You have independently evaluated the desirability of using YouJustGetMe.com, and are not relying on any representation, guarantee, or statement other than as set forth in these Terms & Conditions.
